Terms of Use

Last updated: 05.11.2026

1. General provisions

These Terms of Use (the “Terms”) govern access to and use of the Driverphone website, mobile applications and services provided by DRIVERPHONE S.R.L. The Terms apply to registered users and, where relevant, to persons accessing public features, including by scanning a QR code.

Please read these Terms before using the services. Where the law or the nature of a feature requires express acceptance, this will be requested through the service interface. Merely visiting a public page does not, in itself, constitute acceptance of contractual obligations requiring explicit consent.

2. Service provider

The service provider is DRIVERPHONE S.R.L., with its registered office in Bucharest, 6 Nucului Street, Block V-101, Entrance 2, Floor 3, Apartment 41, Room 1, Sector 3, Romania, tax identification number 50079486, Trade Register number J40/9745/2024, EUID ROONRC.J40/9745/2024, hereinafter referred to as “Driverphone”.

3. Definitions
  • Platform: the www.driverphone.com website, Driverphone mobile applications and related features.
  • User: any person using the Platform, with or without an account, as applicable.
  • Consumer: a natural person acting for purposes outside their trade, business, craft or profession, as defined by applicable law.
  • Account: the individual profile created to access certain features.
  • Vehicle: a vehicle registered or managed on the Platform by an authorized person.
  • Driverphone sticker: the physical medium containing a QR code that can be linked to Platform features.
  • Services: free features or, where offered, paid features, under the conditions presented to users before entering into a contract.
4. Description and scope of services

Driverphone facilitates communication with persons responsible for vehicles, including to report situations such as blocked access, open windows, lights left on or other relevant circumstances. The Platform may allow account creation, vehicle registration and management, vehicle association and transfer, use of QR codes, messaging, internet-based calls, notifications and configuration of privacy options.

Certain features may be available only in specific countries, application versions, account types or technical conditions. Driverphone may also offer features for organizations under the conditions displayed on the Platform.

Driverphone is not an emergency service. In the event of immediate danger, an accident, a crime or another emergency, contact the competent authorities or public emergency services.

5. Technical requirements

Use of the Platform requires a compatible device, internet access and an up-to-date browser or compatible application version. Certain features may require access to the camera, notifications, microphone, location or other permissions, depending on the features used.

Users can manage permissions in their device settings, understanding that denying permissions may limit certain features. Internet, mobile data and telecommunications costs are borne by users under their agreements with their providers.

6. User account

An Account may be required for certain features. Users must provide accurate and up-to-date information, keep authentication credentials confidential and promptly report suspected unauthorized access.

An Account is intended for the person who created it, except where the Platform expressly allows roles to be assigned, management to be delegated or a vehicle to be transferred. User responsibility for activities within an account is determined within the limits established by law.

7. Rules of use

Users must use the Platform lawfully, in good faith and with respect for the rights of others. Harassment, threats, discrimination, impersonation, fraud, attempts to obtain data without authorization, unsolicited commercial communications and repeated contact intended to intimidate are prohibited.

It is prohibited to register or manage another person’s vehicles or QR codes without authorization, circumvent security measures, disrupt the Platform or collect data automatically without authorization. These rules do not prohibit the use of public search or contact features expressly made available by Driverphone.

8. User content and messages

Users are responsible, as provided by law, for messages, reports and other information they submit through the Platform. Illegal, misleading or threatening content, or content infringing the rights of others, must not be submitted.

Under the law and in a proportionate manner, Driverphone may restrict access to content or certain features where necessary for security, abuse prevention or compliance with legal obligations. To the extent that particular features fall within the scope of Regulation (EU) 2022/2065 on digital services, the relevant obligations under that Regulation will also apply.

9. Stickers, QR codes and vehicles

Driverphone QR codes are identifiers used to access features associated with a vehicle. Copying, altering or deceptively using another person’s QR code is prohibited.

Users must be entitled to register and manage vehicles associated with their Accounts. Information entered must be accurate. Driverphone may implement vehicle verification, claim or transfer procedures to prevent disputes and misuse.

Scanning a QR code may allow contact without installing the application. The personal information displayed depends on the user’s settings and choices. Internet-based calls may conceal the telephone number from the other party without guaranteeing absolute anonymity vis-à-vis technical providers or competent authorities, as provided by law.

10. Orders, payments and delivery

Basic Driverphone features are provided free of charge under the conditions displayed on the Platform. Physical stickers may be offered free of charge with shipping payable, or under other conditions communicated before an order is placed. Any price, delivery charge or additional cost will be clearly displayed before an order involving payment is confirmed.

Before a distance contract is concluded, consumers will receive the mandatory information about the product or service, total price, payment methods, delivery and other applicable conditions. Payments and deliveries may be handled by third-party providers, as indicated during checkout.

11. Sales through partners and distributors

Driverphone products may be marketed directly or through commercial partners, distributors, resellers, physical retail outlets, e-commerce platforms or other authorized sales channels. Driverphone may work with distributors for particular countries or regions, including under exclusive distribution agreements, in compliance with applicable law.

Depending on the sales arrangement, a partner may act in its own name and for its own account or in the name and on behalf of Driverphone. The identity of the contractual seller must be disclosed to the buyer before the contract is concluded, as required by applicable law. The mere use of the Driverphone brand on a product or at a point of sale does not, by itself, mean that DRIVERPHONE S.R.L. is the seller of that product.

The seller identified in the transaction is responsible for the obligations imposed on it by law and the sales contract, including pre-contractual information, pricing, payment, delivery, withdrawal rights, conformity of goods and complaints relating to the purchase. Where a partner sells in the name and on behalf of Driverphone, the parties’ obligations are determined by their actual legal roles and the applicable rules. Nothing in these Terms removes any legal liability of Driverphone or the partner where such liability exists.

Prices, promotions, payment methods and delivery conditions may differ between sales channels, within the limits of the law. The commercial terms of an independent distributor apply to purchases made from that distributor, without replacing these Terms of Use for Driverphone digital services.

Regardless of the authorized purchase channel, the Platform’s digital services and the activation and use of QR codes are provided by Driverphone and governed by these Terms, unless another provider is expressly identified for a separate service. An authentic Driverphone sticker may be activated and used through the Platform regardless of the country or authorized channel of purchase, subject to compatibility, service availability and technical or legal restrictions communicated to the user.

Distribution and resale agreements with partners are separate from these Terms intended for Platform users. Mandatory consumer rights remain unaffected.

12. Consumer right of withdrawal

For distance contracts for which the law provides this right, consumers generally have 14 days to withdraw without giving a reason, under the conditions and from the starting point specified by applicable law.

Exceptions to the right of withdrawal apply only where the legal conditions are met. For example, special rules may apply to goods made to the consumer’s specifications or to certain services fully performed after obtaining the consent and acknowledgements required by law. It must not automatically be assumed that every QR sticker is a personalized good exempt from withdrawal.

Information on exercising withdrawal rights, any return shipping costs and the withdrawal form or notification method will be provided to consumers where required for the relevant order. These Terms do not reduce statutory rights.

13. Complaints and consumer rights

Users may submit inquiries and complaints concerning the Platform, services provided by Driverphone or orders for which Driverphone is the contractual seller to contact@driverphone.com, describing the issue and providing, where necessary, information enabling the request to be identified.

For orders placed with independent resellers, complaints concerning the sale should generally be addressed to the seller identified in the transaction, without prejudice to the buyer’s statutory rights against other responsible parties. Driverphone will handle complaints falling within its responsibility without undue delay and within the time limits required by applicable law. These provisions do not limit statutory rights concerning conformity of goods, digital content or digital services, or the right to contact competent authorities.

14. Intellectual property

The Driverphone name, graphic elements, texts, interfaces, images, software and other materials on the Platform are protected by intellectual property laws and belong to Driverphone or their respective rights holders.

Use of the Platform does not transfer intellectual property rights to the user. Materials may be used only to the extent necessary for lawful use of the services and as permitted by law.

15. Availability, communication and liability

Driverphone makes reasonable efforts to ensure the operation and security of the Platform. Interruptions or delays may occur due to maintenance, updates, errors, internet connections, devices or third-party providers.

We do not guarantee that scanning a QR code, sending a message or initiating a call will result in immediate contact with the recipient or a response. Driverphone facilitates communication but does not control the conduct of persons using the service.

Nothing in these Terms excludes or limits Driverphone’s liability where such exclusion or limitation is prohibited by law, including mandatory consumer protection rules.

16. Third-party services and websites

The Platform may contain links to or integrations with independent services, such as payment processors, couriers, app stores or technical infrastructure providers. These services may have their own terms and policies. Driverphone does not control the content of independent third-party websites, subject to the limits established by law.

17. Privacy, cookies and notifications

The processing of personal data is explained in the Privacy Policy, and the use of cookies and similar technologies in the Cookie Policy. Users can configure certain visibility and contact preferences within the features available.

The Platform may send operational notifications concerning calls, messages, Account security or vehicle management. Marketing communications are sent only as permitted by law, respecting user choices and the rights to object or withdraw consent, as applicable.

18. Suspension and termination of use

Users may stop using the services and may request or perform Account deletion through the available means, subject to legal obligations to retain certain data.

Driverphone may temporarily restrict a feature, suspend or close an Account in cases of serious breaches of these Terms, reasonable suspicion of fraud, security risks or legal obligations. Measures will be proportionate, and information and avenues for appeal will be provided where required by law.

19. Changes to the Terms

We may update these Terms due to changes in legislation, technology, security or the services. The updated version will be published with its date. Material changes will be communicated in advance where required by law, and renewed agreement will be requested if necessary.

Changes do not retroactively affect acquired rights and cannot remove mandatory consumer protections.

20. Governing law and dispute resolution

These Terms are governed by Romanian law, without depriving consumers of the protection afforded by mandatory provisions of the law of the country in which they habitually reside, where applicable under private international law rules.

Any disputes will be resolved by the courts having jurisdiction under the applicable jurisdiction rules. Consumers may also use available alternative dispute resolution mechanisms as provided by law. Nothing in these Terms imposes mandatory arbitration or exclusive jurisdiction to the detriment of consumers’ statutory rights.
